In each case, a legal surrogacy contract is curated between the surrogate and the intended parents to avoid any violation of parental rights and ethics in the future. An attorney is required for this. The surrogate may or may not be compensated for her services, but all the medical expenses, traveling allowances, legal procedures, etc are to be looked after by the intended parents.
Who Is Eligible For Surrogacy Services?
Any person willing to become a parent and is not able to conceive naturally or has infertility is eligible for commercial surrogacy services. However, depending on the country you live in, surrogacy laws may differ and prohibit you from becoming a parent through surrogacy. There are surrogacy-friendly countries and there are non-surrogacy-friendly countries and thus, even when you are eligible to become a parent through surrogacy your country or state’s law may not permit you to do so.
For example in India, lesbian surrogacy, gay surrogacy is not yet permitted ,whereas commercial surrogacy is legal. In the United States, some regions permit commercial surrogacy while some do not.

The basic criteria to be a surrogate for any agency is that a surrogate must be a non-smoker, a healthy woman who is at least 21 years with a healthy body mass index ( BMI ) and having a stable lifestyle and support system.
