Surrogacy entails a woman who is willing to carry the baby of the intended parent in her uterus till the baby is born. This woman is referred to as the surrogate mother or carrier. The baby shares no genetic link with the surrogate mother and is only in her uterus for nourishment and growth. Depending on the medical condition of the intended parents, the baby may or may not be genetically linked with them. 

For example in cases of severe infertility of both the partners, egg and sperm donor is used, and hence the baby is not biologically related to either of the intended parents. In cases where only one partner is infertile, the baby is genetically linked to one of the parents. In cases of same-sex surrogacy, the two partners can decide among themselves to be the genetic father and the same applies to two female partners.

In each case, a legal surrogacy contract is curated between the surrogate and the intended parents to avoid any violation of parental rights and ethics in the future. An attorney is required for this. The surrogate may or may not be compensated for her services, but all the medical expenses, traveling allowances, legal procedures, etc are to be looked after by the intended parents. 

Who Is Eligible For Surrogacy Services?

Any person willing to become a parent and is not able to conceive naturally or has infertility is eligible for commercial surrogacy services. However, depending on the country you live in, surrogacy laws may differ and prohibit you from becoming a parent through surrogacy. There are surrogacy-friendly countries and there are non-surrogacy-friendly countries and thus, even when you are eligible to become a parent through surrogacy your country or state’s law may not permit you to do so.
